1. The Defendants, with the exception of the Plaintiffs A, shall be deemed to have the remainder of the Plaintiffs, as indicated in the attached Form 2.
Reasons
1. The following facts may be found either as a dispute between the parties or as a whole by taking account of the respective descriptions of Gap evidence of 1 to 3, 5, 7, Eul evidence of 1, 4 and 5, Eul evidence of 1 to 3, 5, 7, and 10 (including each number), and the whole purport of the pleadings.
1) Defendant New Card Co., Ltd. (former El branch card Co., Ltd. takes over the entire credit card business from the old Credit Card Co., Ltd. on Oct. 1, 2007 and changed its trade name at present), and Defendant NBB’s National Card Co., Ltd., Ltd., a lawsuit taking over the National Bank of Korea (the National Bank of Korea, a national bank, was established on Feb. 28, 201 by dividing the credit card business into a divided date pursuant to Article 530-2 of the Commercial Act, and the part of the credit card business was separated. Article 2(6) of the Division Plan provides that the above Defendant comprehensively succeeds to the rights and obligations related to all assets and lawsuits related to the credit card business sector.
() Samsung Card Co., Ltd., Hyundai Card Co., Ltd., Hyundai Card Co., Ltd, Hyundai Card Co., Ltd., Ltd., (the former Shin Card Co., Ltd. transferred all of its credit card business to EL branch on October 1, 2007 and changed to its current trade name); Han-hwan Bank, Han-chul Card Co., Ltd. (hereinafter the above Defendants, respectively, are classified into “Defendant EL branch card”; “Defendant Defendant’s Gu citizen bank”; “Defendant Samsung Samsung Card”; “Defendant Hyundai Card”; “Defendant’s New Card”; “Defendant Foreign Exchange Bank”; and “Defendant Digital Card”; and all of them are called “Defendant Credit Card Co., Ltd.”.
Under Article 2 of the Specialized Credit Financial Business Act, companies operating the settlement of payments related to the use of credit cards, issuance and management of credit cards, etc. under the Monopoly Regulation and Fair Trade Act (hereinafter “Fair Trade Act”).
