The defendant's appeal is dismissed.

1. The sentence imposed by the court below (three years of imprisonment) is too unreasonable.

2. The fact that the Defendant led to the confession of the instant crime while committing the instant crime, and that the Defendant actively cooperated in the investigation, etc. is favorable to the Defendant.

However, in light of the addiction of narcotics and the harm caused by administration of narcotics, it is necessary to strictly punish and eradicate narcotics crimes.

The Defendant possessed a considerable amount of philophones and marijuana, administered philophones on his own, and issued and sold philophones to many people.

In addition, the defendant has been exposed to the general public that he would sell philophones by using crypting rinks in the process. These crimes are easily exposed to narcotics-related crimes by those who do not have a crypting cryp to narcotics, and thus, their possibility of criticism is very high.

The defendant has a criminal record of having been sentenced to imprisonment several times due to the same criminal act, and in particular, even though he was aware of the period of repeated crime due to the same criminal act, he committed the crime of this case without being aware of it.

In addition to the above unfavorable circumstances, considering the Defendant’s age, character and conduct, environment, motive, means and consequence of the instant crime, circumstances after the crime was committed, and all of the sentencing conditions indicated in the instant records and arguments, such as criminal records, etc., the sentence imposed by the lower court is too unreasonable. Thus, the Defendant’s assertion is without merit.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
