Reasons
Punishment of the crime
The defendant is the manager of C, and the victim D is the joint and several liability obligor for the amount unpaid to the health equipment purchased by E in the factory of the defendant.
Around September 17, 2006, the Defendant filed a lawsuit against E and the victim for the purchase of goods with payment of KRW 71,247,400,00 for the amount unpaid to the Health Center, and on June 17, 2008, the Seoul High Court paid KRW 50,000,000 to the Plaintiff (Defendant E) at the Seoul High Court, and the remainder after deducting the amount the Plaintiff received as provisional execution under the judgment of the first instance from KRW 30,000,000 from the provisional execution under the judgment of the first instance shall be paid until July 10, 200, and the amount shall be paid until August 31, 2008.
However, the defendant and the victim did not implement the above mediation clause.
