A defendant shall be punished by imprisonment for not less than one year and six months.
Seized evidence 1 to 3 shall be confiscated from the accused.
Reasons
Punishment of the crime
1. From September 23, 2017 to September 00:14, 2017, the Defendant: (a) committed a theft by means of: (b) having construction tools in total amounting to KRW 400,000,00 in the market price of KRW 1.8,000,00 in the market price of the victim’s possession, the Defendant: (c) had the construction sections in total amounting to KRW 1.8,00,000,000 in the construction site of the “D apartment at Gangwon-si, Gangwon-si,” which were newly constructed by the victim C in the construction site, in front of the CE container site office managed by the victim C; and (d) had damaged the entrance knife for the purpose of cutting the construction section and invaded inside the said office; and (d) had invaded the building section by means of loading the knife and loaded the froce freight onto the vehicle.
Accordingly, the defendant, at night, stolen the victim's property by damaging the door of the structure that the victim can receive, and impairing the structure.
2. The Defendant: (a) committed a theft in front of the H container site office managed by the victim G G in the new site of the said apartment building at the time indicated in paragraph (1); (b) destroyed the entrance knife part with the intention of thefting the construction section; and (c) intruded the inside of the said office by an influence method; and (d) the victim, who was kept in custody at the said place, committed a theft by using two construction tools in excess of KRW 800,000,000,000 in the market price, including two piracys in excess of KRW 300,000,000 in the market price; and (b) two construction tools in excess of KRW 11,10
Accordingly, the defendant, at night, stolen the victim's property by damaging the door of the structure that the victim can receive, and impairing the structure.
3. The Defendant for special theft against the victim I was in front of the victim I in the new apartment construction site office managed by the victim I at the time set forth in paragraph 1, and the victim was in possession of the victim, who damaged the entrance knob by an act of fire for the purpose of cutting off the construction section and invaded inside the said office with the aim of cutting off it.
