A defendant shall be punished by imprisonment for not less than eight months.
The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.
Reasons
Punishment of the crime
1. On February 5, 2014, the Defendant, around 12:00 on February 5, 2014, committed indecent act by compulsion, the Defendant called “eachwhere there is no angle at the market price.” On the first floor of the Embur 1 floor operated by the victim D (n, 65 years of age) in Gwangju Dong-gu, e.g., “on the other hand, if there is no angle at the market price.” On February 5, 2014, the Defendant: (a) brought his/her sexual flag back back to the son’s son’s son; and (b) committed indecent act by compulsion him/her by force.
2. 2014. 2. 6.경 강제추행 피고인은 2014. 2. 6. 11:00경 위 E모텔 1층 주방에서 “하고 잡어(성행위를 하고 싶어) 죽겠는데 돈이 없어 하도 못하고 환장하겄다.”라고 말하면서 갑자기 위 피해자를 강하게 끌어안은 다음 손으로 그녀의 유방을 주물러 만지고, 피고인의 성기 부위를 그녀의 엉덩이 부위에 밀착시킨 상태에서 앞뒤로 흔드는 성행위 행동을 하며 비비는 등 그녀를 강제로 추행하였다.
3. On February 20, 2014, the Defendant: (a) received a demand from the Defendant that the said victim does not talk or leave the victim on the first floor of the EM at around 11:00 on February 20, 2014; (b) stated, “I do not have any money to want to do so; and (c) nicking the Defendant’s sexual flag into the Defendant’s sexual flag with his her mar, thereby committing an indecent act by force, such as rain, etc., while committing sexual intercourse.
4. On February 25, 2014, around 10:00 on February 25, 2014, the Defendant committed an indecent act by compulsion against the said female by compulsion by force, such as: (a) the Defendant, on the first floor corridor of the said EMM, received a demand for the said victim to talk with the said victim on the first floor of the said EMM; and (b) the Defendant, at the same time, forced the said female by compulsion by force, by stating that “I am a person who would die in his/her own hand.”
5. On February 27, 2014, the Defendant, at around 10:00 on February 27, 2014, provided that around 10:00, the Defendant provided the said victim with KRW 20,000 under the pretext of drinking up the said victim, and accessed the victim’s own knife, and boomed the female with his/her hand.
