A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 26, 2016, the Defendant: (a) was a person who was returned to E, who had been waiting for a victim before the home of the victim D(M, 47 years of age) located in Seongbuk-gu, Sungnam-si; (b) on March 26, 2016, and (c) was a person who was married to E, who was married to, and returned to, the victim; and (d) was liable for divorce.

It stated to the effect that it was 80 million won to give consolation money to the previous wife, which was prepared to the effect that it was insufficient to pay consolation money of KRW 100 million.

Accordingly, whether the victim would give more attention to the money;

When refusing to give money, the Defendant refuses to “I will not give money,” and the Defendant has a sexually related video image of E, who is his/her father and wife, to spread it.

The Defendant and E expressed dynamic images of sexual conduct stored in the Defendant’s mobile phone, which would not spread the video once, thereby threatening the victim as if he were aware of the sexual conduct of the victim’s 20 million won.

After that, the Defendant from April 1, 2016 to the same month.

4. Until May 2, 2016, the victim’s cell phone text message stating that it is necessary to assist the victim at present and the Defendant’s bank account number is continuously sent. On April 6, 2016, the victim expressed that “I would like to talk about E without giving money to the victim,” and that “I would like to talk about E without giving money to the victim,” which was already frighted by intimidation to spread sexually associated videos. If the victim did not know about KRW 20 million, I threatened the victim with harm against E or spread the screen image taken by the Defendant’s sexual act scene.

The Defendant attempted to threaten the victim to take money from a person who was frighten by threatening him, but did not have the intent to refuse it and give money to the victim, but did not commit an attempted crime.
