A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 07:00 on October 20, 2014, the Defendant driven a car by a CBelgium with a blood alcohol concentration of about 0.066% from the 27km section from the 31st day of the art hall-ro in the original city to the national highway of about 42 meters in front of the 1st century in the original city.

2. The Defendant in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents is a person engaging in driving a Belgium car.

On October 20, 2014, the Defendant driven the said car under the influence of alcohol of 0.066% of alcohol concentration at a speed of approximately 110km per hour from the side of the door-to-Eup in order to drive the road at a speed of about 42 meters per hour from the front-to-Eup in order to drive the vehicle at a speed of 0.06%.

At the time, the lower level of the road is getting off, and it is a bend road with a speed of 80 km a speed limit, so there was a duty of care to safely drive the driver of the vehicle by reducing the speed and accurately manipulating the steering and brakes.

Nevertheless, under the influence of alcohol, the Defendant neglected to do so and proceeded at a restricted speed exceeding 30 km per hour, and brooms down into brooms, and the Defendant’s right shouldered to the right part of the car above, and continued to receive the central separation zone of the left side of the road on the part of the upper part of the left part of the car above.

Ultimately, the Defendant caused the death of the victim D (the age of 43) who was accompanied by the said car by occupational negligence.
