피고인은 2014. 2. 7. 23:12경 서울 송파구 C에 있는 ‘D슈퍼’에서 피해자 E(53세)이 “복권 당첨이 잘 안 된다”며 불평을 하는 것을 듣고 시비를 벌이던 중 화가 나, “이 씨발놈 죽여버린다, 이놈의 새끼 죽인다, 개쌔끼, 씨발놈”이라고 욕설을 하면서 피해자의 멱살을 잡아서 밀치고, 주먹으로 피해자의 얼굴, 복부, 가슴을 수회 때려 피해자에게 약 14일간의 치료를 필요로 하는 흉곽 전벽의 타박상, 안면부와 경부의 타박상의 상해를 가하였다.
