A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On January 8, 2016, the Defendant was sentenced to one year of imprisonment for special assault, etc. at the Gwangju District Court, and the execution of the sentence was completed on July 31, 2016 at the Ganpo Prison.

1. 가. 2016. 8. 12. 범행 피고인은 2016. 8. 12. 00:00경부터 00:50경까지 위 D 앞길에서 위 마트 종업원인 피해자 H, I으로부터 휠체어를 타고 있는 피고인이 매장 안에 들어 와 물건을 고르기가 힘드니 매장 밖에서 기다리면 원하는 물건을 가져다주겠다는 말을 듣고는 피해자 H를 향해 ‘뚱땡이, 씨발놈아, 개새끼야’라고 욕설을 하고, 앞에 진열되어 있는 수박과 사과를 손으로 밀어 바닥에 떨어뜨리고, 마트 앞에 놓여 있던 비닐봉지를 바닥에 떨어뜨린 후 마트 입구에 휠체어를 세워 둔 채 바닥에 앉아 마트에 들어가려고 하는 손님들을 향해 ‘씹할 놈들, 뭐야 이 새끼들아’라고 계속하여 욕설을 하고 바닥에 드러눕는 등 행패를 부려, 위력으로 피해자들의 상점 운영업무를 방해하였다.
