A defendant shall be punished by imprisonment for not less than eight months.

1. 피고인은 2015. 7. 3. 18:00경 의정부시 민락동 OOOOOO 식당 앞에서 마침 그곳을 지나가던 피해자 D(16세)이 피해자 C(60세)을 협박하던 피고인을 말리자 소지하고 있던 위험한 물건인 식칼(총길이 약 30CM)을 꺼내들고 D의 목을 향해 겨누면서 “죽고 싶냐! 이런 좃만한 새끼, 사시미 칼로 목을 확 따줄까!”라고 위협하였다.

계속해서 피고인은 위 D의 연락을 받고 찾아온 피해자 E(16세)을 향해 오른손 주먹으로 때릴 듯이 휘두르며 “좃만한 새끼야, 왜 쳐다봤어, 씹할놈아 눈깔어, 좃나게 팬 다음 깽 값 물어 주면 되니 경찰 불러 개새끼야!”고 말하면서 겁을 주었다.
