Reasons
Punishment of the crime
On October 8, 2014, at around 09:20, the Defendant: (a) discovered and opened a seat in the front line with the shorter string line of the subway No. 393 subway No. 2 in Mapo-gu, Mapo-gu, Seoul, the Defendant taken the body of the victims six times in total from August 8, 2014 to October 8, 2014, using the Kamera function of Samsung T&M-B510L cell phone (SM-B510L) in the victim’s cell phone (SM-B510L), as shown in the annexed crime list, and taken the body of the victims six times in total from August 2014 to October 8, 2014.
Accordingly, the defendant taken the body of the victims who could cause sexual humiliation or shame by using mobile phone cameras against their will.
