The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 2,500,000.

1. The court below found the defendant not guilty of the charges of defamation under the Criminal Act, since the defendant sent a postal item containing false facts to the NAF members, and the court below found the defendant not guilty of the charges of defamation.

Before the judgment on the grounds for appeal ex officio, the prosecutor examined the facts charged in this case ex officio prior to the judgment on the grounds for appeal of ex officio, and the prosecutor changed the facts charged in this case to the following, and applied for permission to change the name of the crime and the applicable provisions of Acts to “defacing” and “Article 307(2) of the Criminal Act”.
