Defendant D’s KRW 300,520,501 on September 3, 2020 to October 22, 2020, and the following.

1. Basic facts

A. The Plaintiffs are owners of multi-household housing and neighborhood living facilities that are to be newly built on the land in Mapo-gu Seoul Metropolitan Government, and Defendant C Co., Ltd. (hereinafter “Defendant C”), regardless of whether it was before or after the mutual change, is a company engaging in construction business; Defendant D is a person engaged in construction business in the trade name of H; Defendant E (hereinafter “Defendant E”) is a company engaging in design and supervision business.

B. On February 27, 2018, the Plaintiffs entered into the instant construction contract (hereinafter “instant construction contract”) with Defendant D and Seoul Mapo-gu Seoul Mapo-gu Construction Project that newly constructs multi-household houses and neighborhood living facilities on the land (hereinafter “instant new construction project”).

(1) A construction contract to be executed by Defendant D with a fixed period of construction from March 2, 2018 to July 31, 2018 (excluding value-added tax) and KRW 663,00,000 (excluding value-added tax), advance payment of KRW 300,000,000 (hereinafter “instant construction contract”).

(1) The KG (Defendant C) submitted to the Bank for verification of the actual value of the transaction.

C. On February 27, 2018, Defendant D prepared a construction work-based standard contract with Defendant C as contractor, using the seal of the Plaintiffs, with regard to the construction period from March 2, 2018 to August 31, 2018, “58,00,000 additional tax”, “supply amount”, “project owner,” and “contractor C”, and the construction work-based standard contract with Defendant C, and the said contract contains contents that designate Defendant D by field supervision.
