피고인은 2013. 5. 9. 20:30경 남양주시 C 앞 노상에서 피고인이 주차한 차량으로 인해 통행에 방해가 된다는 신고를 받고 출동한 남양주경찰서 D파출소 소속 경장 E로부터 차량을 이동해 달라는 요구를 받자 “씨발놈아, 나이도 어린 것이 내 아들 뻘이야! 너 이 새끼! 저리 안 꺼져! 죽여 버린다! 내가 뭔 잘못을 했는데 나와서 이 지랄이야! 개새끼들아!”라고 욕설을 하고, 때릴 듯 손을 들어 위협하고, 몸으로 위 경찰관을 밀쳐 112 신고업무 처리에 관한 위 경찰관의 정당한 직무집행을 방해하였다.
