1. No person violating the Trademark Act shall deliver, sell, forge, or possess a trademark identical with the registered trademark of another person for the purpose of using it for goods identical with the designated goods

그럼에도 피고인은 면세담배의 출고가가 1보루 당 10,000원인 반면 국내 판매용 담배는 출고가가 1보루 당 22,500원이므로 면세담배를 국내 판매용 담배인 것처럼 가장할 경우 출고가 차액만큼의 유통마진을 취득할 수 있다는 점을 이용해 유통마진을 늘리고자 면세담배 위에 위조 스티커를 부착하는 방법으로 속칭 짱구담배(면세담배를 국내 판매용 담배인 것처럼 가장한 담배)를 제조판매하기로 마음먹었다.

피고인은 2012. 12.경 D(2013. 12. 6. 사망)으로부터 ‘KT&G, 매너공감’이라는 문구와 케이티앤지(KT&G)에서 생산되는 제품의 품명별 고유 바코드가 기재되어 있는 위조 스티커를 건네받아 그 위조 스티커를 같은 품명 면세담배의 ‘KT&G, DUTY FREE'라는 문구와 바코드가 기재되어 있는 부분에 부착하는 방법으로 짱구담배 제조 작업을 마친 다음 그 무렵 인천 연수구 E에 있는 F 창고에서 에쎄라이트, 에쎄순 짱구담배 150보루(30상자)를 3,075,000원에 판매한 것을 비롯하여 그때부터 2014. 3.경까지 별지 범죄일람표 1 기재와 같이 28회에 걸쳐 G, H에게 위조 스티커가 부착된 짱구담배 7,095보루를 합계 141,410,000원에 판매하였다.
