A defendant shall be punished by imprisonment for one year.

838,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

On May 28, 2014, the Defendant was sentenced to one year and four months for the violation of the Act on the Control of Narcotics, Etc., and completed the sentence on April 10, 2015.

1. On May 31, 2015, the Defendant: (a) decided to purchase a penphone from C around May 31, 2015; (b) purchased KRW 200,000 from C to D’s account (Account Number E) in the name of D used by C; and (c) transferred KRW 200,000 to 7.5,50,000 won from G located in Seojin-gu F on the same day prior to the same day, by using high-speed bus freight delivery service; and (d) received a one-time injection with approximately 0.4 grams, sent by C by using high-speed bus freight delivery service; and (e) purchased KRW 1.57,000,000 in total using a penphone over six times from that day to August 29, 2015, as indicated in the attached list of crimes.

Accordingly, even if the Defendant is not a person handling narcotics, the Defendant traded psychotropic drugs.

2. On October 16, 2016, the Defendant purchased philophones from a person whose name is unknown (one name H) to purchase philophones. From the male toilet of the first floor of the J hotel in Bupyeong-gu Incheon Metropolitan City, a person whose name is unknown, who finds it difficult to identify the above name in the tape on the back side of the philophones which contain approximately 0.25g of philophones, and then put KRW 100,000 of philophones into the blograms in the blost tank.

Accordingly, even if the Defendant is not a person handling narcotics, the Defendant traded psychotropic drugs.

3. Medication of phiphones.

A. At around 17:00 on October 16, 2016, the Defendant placed about 0.1g of philophones purchased from a person whose name cannot be known in the middle of the G hotel located in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, in a philost for daily use, and melted them with water, and injected them into the Defendant’s arms.

B. The Defendant, around October 16, 2016, takes notes from the Defendant’s house located in Jeonjin-gu, Jeonjin-gu, Jeondong-gu.
