The prosecution of this case is dismissed.

1. Around 08:40 on November 8, 2019, the Defendant assaulted the victim’s face by drinking in front of the Busan Shipping Daegu building on the ground that the victim C (the 36-year-old age) was bad and bad in terms of drinking around 08:40 on November 8, 2019, and drinking the victim’s breath, with his hand, breathing the breath, and destroying the victim’s breath with the victim’s face.

2. The judgment of the court below is a crime that cannot be prosecuted against the victim’s clear and intentional intent pursuant to Article 260(3) of the Criminal Act.
