Reasons
1. Facts of recognition;
A. The Plaintiff is a person who operates a construction design business with the trade name of “C”, and the Defendant was a regional housing association established to implement a housing construction project at the Dail-si, Kimhae-si, and was authorized to establish an association on June 8, 2017 from the Kimhae-si market.
B. On June 16, 2016, the Plaintiff entered into a building design contract (hereinafter “instant contract”) with the E-Regional Housing Association (hereinafter “Promotion Council”) regarding the “F apartment construction works in Gimhae-si,” and the content relating to the instant case is as follows.
A design contract for a building;
1. Design contract title: Construction of the F apartment in Kimhae-si;
2. Site location: G worker in Kimhae-si.
3. Design outline 1) Site area: 21,652,00 square meters: Size of multi-unit housing (multi-unit housing) construction: 1st underground floor and 12-28 floor: 5th floor area: 57,424 square meters (17,370,95 py);
4. Total contract amount: Additional tax on daily gold n.e., 660,000 n.e., n. n. n. n. n. n. n. n. n. n. n. n. n. n. n. n. n. n.
Article 1 (General Provisions) of the General Conditions of the Contract (38,000 won) This Agreement shall determine the mutual rights, duties, etc. necessary for the performance of design duties entrusted to the owner of the building, the defendant, the agent company, the H (hereinafter referred to as the "A") and the C architect (hereinafter referred to as the "B") who has reported on the business under Article 23 (1) of the Certified Architects Act pursuant to Article 15 of the Building Act.
Article 2 (Period of Service) The period from the date of execution to the date of approval for use.
Article 3 (Scope of Services) The scope of services provided by Article 3 (Scope of Services) “B” to “A” is as follows:
1. Planned design documents;
2. Interim design documents (written approval and permission use);
3. Working design documents;
4. Books subject to deliberation, if necessary.
5. Specifications by type of work; and
6. Various statements of accounts (structure, facilities, and electricity);
7. Lighting photography;
8. When of approval for use.
