A defendant shall be punished by imprisonment for not more than ten months.

except that the execution of a sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 4, 2018, from around 04:06 to around 04:40, the Defendant driven Cone Starex with alcohol content of about 8km from around the front of Yeongdeungpo-gu Seoul to the front of the same Gu, Yeongdeungpo-gu to around 0.185%, while under the influence of alcohol content of about 0.185%.

2. On February 4, 2018, the Defendant violated the Road Traffic Act (unnecessary Measures after Accidents) driving the above van around 04:06 on February 4, 2018, and led the front road of Yeongdeungpo-gu Seoul Metropolitan Government to the front side of the Military Court of War B from the Yeongdeungpo-gu's protection area of prisoners of war.

At the time, there are nights and vehicles that contain a string and parking machine at the front, so the driver of the vehicle has a duty of care to prevent accidents by accurately operating the steering gear and brakes while living well in the front.

Nevertheless, the Defendant was negligent in failing to properly operate the steering gear and brakes without neglecting his/her duty of care as seen above while driving a breath while under the influence of alcohol.
