A defendant shall be punished by imprisonment for four months.

Punishment of the crime

1. On December 4, 2017, the Defendant, who committed a crime on December 4, 2017, took phone call from the victim B at an irregular place on December 4, 2017, to pay a fine.

A loan of KRW 5 million shall be repaid within ten days from the date of loan.

However, since the defendant did not operate a manpower office, even if he borrowed money from the damaged person as a fine, he did not have an intention to use it as a fine, and there was no intention or ability to pay it.

Nevertheless, the defendant deceivings the victim as above, and he received 5 million won from the victim to the account in the name of C on the same day.

2. On December 21, 2017, the Defendant, who committed a crime on December 21, 2017, had a telephone called to the said victim at an irregular place on December 21, 2017 and had the victim paid a fine for illegal employment by the employees of the manpower office assigned to him/her.

If 5 million won is lent, 10 million won, including all 5 million won, shall be repaid within 10 days.

However, since the defendant did not operate a manpower office, even if he borrowed money from the damaged person as a fine, he did not have an intention to use it as a fine, and there was no intention or ability to pay it.

Nevertheless, the defendant deceivings the victim as above, and he received 5 million won from the victim to the account in the name of C on the same day.

3. On January 12, 2018, the Defendant committed a crime on January 12, 2018: (a) phone call from the victim at an infinite place; and (b) opened the company account in a bank because the office of manpower inside and outside of the bank did not pay income tax.

The 100 million won was discussed.

If a person lends KRW 3 million, he/she will pay taxes to him/her and fully repay 10 million won that he/she borrowed before and after this mold.
