A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2014 Highest 1915]

1. On February 13, 2014, at around 22:00, the Defendant discovered out that the victim E, who is an employee, was posted on the customer, in the D in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, Seoul, a special case of 32, and then stolen a new card, which is the victim’s possession, from the above wall A.

2. Fraud or violation of the Specialized Credit Finance Business Act;

A. On February 13, 2014, the Defendant, around February 22:11, 201, purchased hambs, etc. from the H point operated by the victim G in Bupyeong-gu Incheon, Bupyeong-gu at around 22:11 on February 13, 2014, and settled 6,700 won of the price of goods using the E’s new E card, as described in paragraph (1), when purchasing hambs, etc. from the victim G in Bupyeong-gu, Incheon.

As such, the Defendant deceptioned the above I and received ham, etc. from the above I, and used the stolen credit card.

B. On February 13, 2014, around 22:20 on February 13, 2014, the Defendant settled KRW 10,500 for goods by using the E’s new E card, which was stolen, as described in paragraph (1), at the convenience store operated by the victim under the name in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, at around 22:20 on February 13, 2014.

As such, the Defendant, by deceiving the said L, received a call number from the said L, and used the stolen credit card.

C. On February 13, 2014, the Defendant, around February 22:23, 2014, purchased goods from the victim and settled 9,500 won of goods by using a new E card, as described in paragraph (1), at around 22:23, 2014, the Defendant purchased goods from the victim’s Nart operated by the victim under the name unsound M of the Incheon Bupyeong-gu, Incheon.

The Defendant, by deceiving the victim, received goods from the victim, and used stolen credit cards.

On February 13, 2014, at around 22:29, the Defendant purchased the first call number from the victim P on February 13, 2014 at Q convenience store operated by the victim P in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and used the new E card as described in paragraph 1.
