A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a Vietnamese who entered the Jeju Special Self-Governing Province of the Republic of Korea on January 12, 2016 without a visa, and has not obtained permission to extend his/her sojourn area.

No person shall move into another area of the Republic of Korea without obtaining permission for extension of sojourn area from the Jeju Special Self-Governing Province without a visa.

On January 12, 2016, the Defendant: (a) entered the Republic of Korea through a Jeju International Airport; (b) entered the Republic of Korea through a Jeju International Airport; (c) made a false entry declaration; and (d) entered the Jeju Special Self-Governing Province on February 18, 2016 and stayed in the Jeju Special Self-Governing Province at Jeju Special Self-Governing Province on February 19, 2016; and (c) went to a warehouse under the name of a Vietnam seafarer on the name of the Vietnam seafarer on the ship, without obtaining permission for extension of the area of stay; and (d) went to the port of Han-si Special Self-Governing Province on February 19, 2016; (c) went to the port of land where he/she died in the South Korean Special Self-Governing Province on February 30, 2016.

Accordingly, the defendant entered the Jeju Special Self-Governing Province without a visa and moved to another area of the Republic of Korea without obtaining permission for extension of sojourn area.
