A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Criminal facts

An alien who enters an airport or harbor of the Jeju Special Self-Governing Province without a visa to sojourn in the Jeju Special Self-Governing Province for the purpose of interpretation, etc. of tourism shall obtain permission for extension of sojourn area from the Minister of Justice, if he/she intends to move to any other area within the territory of the Republic of Korea, and no alien shall stay in excess of the sojourn status or sojourn

The defendant, who is a Chinese citizen residing in Black, Symna, Symna C, was living in Jeju Special Self-Governing Province for tourism, was living in Jeju Special Self-Governing Province without permission for extension of sojourn area and was living in the Republic of Korea for illegal stay in the Republic of Korea.

On April 8, 2015, the Defendant entered Jeju Special Self-Governing Province without a visa into the Jeju Special Self-Governing Province for the purpose of sojourn B-2 (tourism) and the period of sojourn for 30 days, and entered the port located in Jeju Special Self-Governing Province on June 30, 2015, pushed down the cargo in a hidden manner, and stayed in the Republic of Korea, such as Mapo-si, Busan, and Kim Sea, from July 1, 2015, after arriving at the port of woodpo-si, Mapo-si, Mapo-si, Mapo-si on July 1, 2015, by February 8, 2017.

Accordingly, the defendant moved in the Jeju Special Self-Governing Province to another area within the Republic of Korea without obtaining permission for extension of sojourn area from the Minister of Justice, and stayed in the Republic of Korea.
