1. The Defendant’s KRW 326,776,326 among the Plaintiff and KRW 317,987,846 among the Plaintiff, shall be from October 16, 2019 to April 17, 2020.
Reasons
1. Basic facts
A. The Plaintiff is a building owner and seller who obtained approval for use on August 8, 2014 with respect to one of the 62 households aggregate buildings and their ancillary facilities (hereinafter “instant building”) of the building Kimpo-si, Kimpo-si, and the Defendant is the contractor of the instant building.
B. On January 24, 2013, the Plaintiff entered into a contract with the Defendant for the construction of the instant building (excluding value-added tax; hereinafter the same shall apply) KRW 880,000 for the construction cost as to the construction of the instant building.
(2) From March 26, 2013 to December 31, 2013, the Plaintiff and the Defendant concluded a contract for construction by setting the period of construction as between March 26, 2013 and December 31, 2013. (2) A contract for change extending the construction completion date from December 31, 2013 to March 31, 2014; and on January 17, 2014, the construction completion date was extended to June 30, 2014; and the construction cost was increased to KRW 10,420,00,000 from KRW 8,880,000 to KRW 10,000; the contract for change extended to July 18, 2014 to July 18, 2014; and the contract for change extended to July 18, 2014 to July 14, 2014 to each other.
C. 1) On February 1, 2018, the C Management Body, an autonomous management body organized by the occupants of the instant building, was transferred from the sectional owners of 58 households among the instant building, in lieu of the defect repair to the Plaintiff and the Defendant, respectively. 2) C Management Body filed a lawsuit against the Plaintiff and the Defendant claiming damages in lieu of the defect repair.
(A) On August 14, 2019, the Plaintiff paid KRW 317,987,846 to the C Management Body on October 16, 2019, the Plaintiff paid KRW 317,987,846 to the Plaintiff on August 16, 2019.
5. In the lawsuit of this case, repayment shall be made to C Management Body according to the plaintiff's loss.
