A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
On August 25, 2006, the Defendant was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and on September 25, 2009, the Seoul Northern District Court was sentenced to three years of imprisonment for the same crime. On December 13, 2013, the Seoul Northern District Court was sentenced to three years of imprisonment for the same crime. On April 18, 2017, the Defendant was sentenced to two years of imprisonment for the same crime in the same court and on March 10, 2019, was sentenced to two years of imprisonment for the same crime.
1. On May 13, 2019, around 13:10 on May 13, 2019, the Defendant: (a) accessed the victim D, where he/she was living in the vicinity of the first floor of Jongno-gu Seoul, Jongno-gu, Seoul, to access the victim D; and (b) cut out one wall owned by the victim D, which includes KRW 6.60,00 in cash from the victim D’s key machine to the victim D.
2. On May 17, 2019, around 12:05, at around 12:05 on May 17, 2019, the Defendant: (a) accessed the Victim F, where the said B World is standing in the first floor E-dong, and (b) removed one victim F-owned wall with cash KRW 300,000,000 from the bank where the victim F was shouldered.
3. On May 25, 2019, around 18:22 on May 25, 2019, the Defendant accessed the victim I, who was working in the vicinity of “H” located in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, and deducted the paper bags containing KRW 183,000 in cash owned by the victim I from the bank located in the victim I et al.
4. On May 30, 2019, around 14:58, 2019, the Defendant thief approaching L L, who was carrying goods in the vicinity of the “K” located in Dongdaemun-gu Seoul Metropolitan Government, and divers L, the Defendant dived L, the victim L, with cash 40,000 won, KRW 40,000, KRW 3,000, KRW 1,500, KRW 1,000, KRW 1,000, KRW 2,000, KRW 3,000,000, market price of which includes one, credit card 3, physical card 3, resident registration certificate, driver’s license, etc.
Accordingly, the defendant was sentenced to punishment twice or more for habitual larceny.
