1. The defendant's appeal is dismissed.

1. The reasoning of the judgment of the court of first instance cited the same reasoning as that of the judgment of the court of first instance, except for the dismissal or addition as follows, and therefore, it is citing it as it is by the main sentence of Article 420 of the Civil Procedure Act.
