A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 8, 2014, the Defendant: (a) was refused to find employment at a entertainment establishment on the ground that he was older than the Defendant’s age; (b) was willing to find employment at a entertainment establishment by deceiving the age more than the actual; and (c) on April 8, 2014, the Defendant searched at the Defendant’s home located in the Internet site B in Sinung-si, B as “facing identification cards; and (d) requested the forgery of his resident registration certificate; (b) discovered the Internet domain address of an unclaimed winner; and (c) requested the forgery of his resident registration certificate; (d) notified the Defendant’s family name, resident registration number, and the Defendant’s mother’s address.

In this context, the person who was unaware of the name was arbitrarily produced the resident registration certificate under the name of the head of Gangseo-gu Seoul Metropolitan Government by inserting the name, resident registration number, address, Gangseo-gu Seoul Metropolitan Government E, 101 Dong 102, and the Defendant’s photograph on the plastic whose size is similar to that of the resident registration certificate of the Republic of Korea in China.

Accordingly, the Defendant forged the resident registration certificate which is an official document without authority for the purpose of exercising the right in collusion with the above person with the above person without authority.

The crime is not good in that it entrusts a professional forged business operator with the reason of sentencing under Article 62(1) of the Criminal Act for the suspension of execution, thereby forging the resident registration certificate of an unqualified person: Provided, That it is against the defendant and is discovered before the receipt of the forged resident registration certificate, merely for employment, it is not a forgery of the resident registration certificate for other crimes, it is not for employment, there is a mother and child to support the defendant, there is no other criminal record, the age, character, and environment of the defendant.
