A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

피고인은 2015. 6. 25.부터 2015. 7. 2. 15:13까지 대구 달서구 B 2 층에 있는 피고인 운영의 ‘C 오락실 ’에서 전체이용 가 아케이드 게임 물인 ‘ 레 전 드애로 우’ 게임 기 40대를 설치한 다음, 위 각 게임기에 당초 등급 분류 받은 게임 물의 내용에 없는 별도의 정산 창을 갖추어 등급 분류 내용상으로는 획득 불가능한 점수가 표시되도록 하여 점수 정산에 사용하고, 게임 화면에 돌고래, 주꾸미, 상어가 나타나면 5천 점씩 점수가 오르는 예시기능과 일정 순간에 대량으로 점수를 획득하는 연타기능을 추가 하여 게임기 조작 버튼 위에 게임 자동 진행장치인 일명 ‘ 똑딱이 ’를 올려놓으면 게임이 자동으로 실행되면서 우연적이고 자동적으로 손님들이 획득한 점수가 누적되도록 하는 방식으로 당초 등급 분류를 받은 게임 물과 다른 내용의 게임 물을 손님들의 이용에 제공하였다.
