Reasons
Punishment of the crime
[criminal power] On June 17, 2015, Defendant A sentenced two years and six months to imprisonment for habitual special larceny at the Daejeon District Court, and completed the execution of the sentence on February 13, 2016.
【Criminal Facts】
1. Defendant A is a person who has a habitive wall of larceny, and a person who is subsequent to B. A.
B, around 00:30 on August 4, 2016, in order to raise living expenses, etc. in front of the Defendant’s residence, the Defendant and B, who committed a joint crime with B, committed a theft of cash, etc. in parked vehicles, and then came to have divided the profits between the Defendant and B and B in proportion to 6:4.

The Defendant reported the network around B, and the Defendant: (a) opened a driver’s seat by inserting it into the key hole of the said cargo vehicle; (b) opened the driver’s seat by placing it on the front line; and (c) used the Defendant’s cash amounting to KRW 20,00,000, the market price of KRW 16,000, which is the victim’s possession of the said cargo; and (d) committed a theft, from around August 6, 2016, the Defendant attempted to steal, or attempted to steal the property at a total of six times in the same way as indicated in the attached List of Crimes (1).
Accordingly, the defendant committed a theft or attempted to steal the victims' property together with B.
B. On July 25, 2016, the Defendant discovered that from around 00:00 to around 05:00 on the same day, K Freight cars, which were owned by the victim J, were parked, and opened a driver’s seat by means of putting them into the key hole, and opened a driver’s seat and enter the said cargo vehicle, and 11,500 won in cash, which is owned by the victim, were stolen.
