A defendant shall be punished by imprisonment for one year.

The defendant shall pay B, who is an applicant for compensation, KRW 15,00,000,00.

Punishment of the crime

[2019 Highest 7495] The Defendant, at the time of Gyeonggi-si, thought that the Defendant was entitled to conclude a sales contract with respect to three lots of land, including the wife C, in the event of Gyeonggi-do, he had the victim B pretended to receive a sales contract from the victim.

1. However, in fact, the Defendant did not have been delegated the authority to conclude a sales contract with the owner of three lots of land, such as the wife population C, at the time of Gyeonggi-do, and even if receiving the money from the victim, he was willing to use it as personal debt repayment, etc., and thus, the Defendant did not have any intent or ability

Around April 17, 2019, the Defendant, by deceiving the victim as such, was delivered KRW 15 million to the Defendant’s D Securities Account under the pretext of investment.

2. On April 17, 2019, the Defendant forged private document: (a) even though he/she was not authorized by the said landowner E to a land sales contract at the coffee shop located in Samsung-dong, Gangnam-gu, Seoul; (b) although he/she did not have been authorized by the said landowner E to a land sales contract, he/she shall pay any balance after lending from financial rights to the buyer in the column of the site where the real estate sales contract is located. (c) In the sale price column of Gyeonggi-do, “Seoul-do wife Population C”, “this KRW 200,000,000”, “one million won” in the down payment column; and (d) in the column of the special agreement, “the purchase price” shall be paid from financial rights to the buyer.

The amount set forth in this case shall be F. G. of the wife population offered as a joint security.
