A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 21:00 on August 9, 200, the Defendant violated the Act on the Punishment of Sexual Crimes and Protection, etc. of the Victims (Indecent act by force in relation to relatives), around 21:0 on the date, at the location of the Defendant’s residence, Kimhae-si (D apartment 1:203), the Defendant’s wife, along with the Defendant’s E (the 12-year old-old-age-old-age-old victim E (the 12-year-old-old-age-old-age-old), put his son over his son in the victim’s her son, and her son’s son’s son in the victim’s her son,

Accordingly, the defendant committed indecent acts by compulsion against the victim's relatives.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

가. 피고인은 2011. 9.경 부산 강서구 F에 있는 피고인의 주거지에서, 위 피해자 E(여, 14세)에게 “얼마나 컸는지 보자 예전에는 피부가 안 좋았는데.”라고 말하면서 피고인의 손을 피해자의 상의 안으로 집어넣고 피해자의 가슴과 젖꼭지를 주무르듯이 만지고, 계속해서 피해자의 바지를 벗긴 다음 피해자로 하여금 바닥에 엎드리게 하고 피고인의 손으로 피해자의 엉덩이를 좌우로 벌려 피해자의 항문과 음부를 유심히 보았다.

Accordingly, the defendant committed indecent acts by compulsion against the victim's relatives.

B.
