A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

가. 성폭력범죄의 처벌 등에 관한 특례법 위반(친족관계에의한강제추행) 1) 피고인은 2012. 1. 하순경 전남 해남군에 있는 피고인 모친의 집 안방에서, 피해자(당시 14세)를 피고인의 배 위로 올라와 엎드리게 한 다음 피해자의 바지 안으로 손을 넣어 엉덩이를 만져, 친족관계에 있는 피해자를 강제로 추행하였다. 2) 피고인은 2013. 7. 17.경 광양시에 있는 피고인의 집에서, 피해자(당시 16세)에게 피고인의 다리를 주무르게 하다가 발로 피해자의 가슴을 비벼 문지르고, 피해자를 피고인의 배 위로 올라오게 한 다음 피해자의 바지 안으로 손을 넣어 엉덩이를 만지고, 계속하여 피해자에게 “뱃살이 얼마나 쪘는지 보자.”라며 피해자의 바지를 음모가 보일 때까지 내린 후 음모 부위를 들여다보아, 친족관계에 있는 피해자를 강제로 추행하였다.
