Reasons
Punishment of the crime
D around September 14, 2002, after being transferred the name of the owner of the building that had been newly built in Dong-gu E, F, and G located in Chungcheongnam-gu, Chungcheongnam-gu, and around June 27, 2003, H Co., Ltd. sold the building to H Co., Ltd. and changed the name of the owner, but the sales contract was cancelled thereafter.
D During the construction process ratio of the above building to approximately 70%, D entered into a contract on January 20, 2004 under the condition that "in the event that full payment of the purchase price is not possible, D or D changes the name of the owner to a third party designated by D or D," and around February 6, 2004, D changed the name of the owner to J as I representative, and I changed the name of the owner to K corporation of which Defendant B was the representative, and around 90% as of September 16, 2004 while the owner was entering into a subcontract, I changed the name of the owner to L as a collateral for loans amounting to about 277 million won.
KK Co., Ltd. employed Ma who had been living in the vicinity of the building and had it manage the building as security guards around December 2004, but notified that it will suspend the management of the building after September 2005, 2005.
D As the above sales contract was not implemented on June 1, 2006, it entered into a contract to sell the above building to N Co., Ltd., and received down payment of KRW 330 million,00,000,000,000. Around June 19, 2006, the J and agreed that the owner shall repay the above L’s debt and restore the name to its original state. A N Co., Ltd entered the building with D on June 20, 2006 and changed the name of the owner to N Co., Ltd. on June 30, 2006.
K Co., Ltd. asserted the right of retention on the building of this case, but on September 14, 2006, K Co., Ltd. in the Daejeon District Court's astronomical Branch of Daejeon District Court against D et al.
