Defendant shall be punished by imprisonment without prison labor for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

피고인은 2013. 1. 22. 11:45경 C 카니발 승용차를 운전하여 강원 고성군 토성면 원암리에 있는 미시령관통도로를 시속 약 60킬로미터로 인제 방면에서 속초방면으로 진행하면서 그곳 도로는 급경사의 내리막 커브길이고 노면이 결빙되어 미끄러운 상황이었으므로 미리 속도를 줄이고 안전한 속도와 방법으로 운전하여야 할 주의의무가 있음에도, 이를 소홀히 한 업무상 과실로 때마침 전방에 서행하고 있는 D이 운전하는 E 스타렉스 승합차를 발견하고도 제동하지 못하고 눈길에 미끄러지면서 피고인의 카니발 승용차 앞부분으로 D의 스타렉스 승합차 뒷부분을 그대로 들이받고, 계속하여 도로 오른쪽에 설치된 가드레일을 들이받아 그 충격으로 튕겨져 나가면서 도로 밖 경사지로 추락하여, 그로 인하여 2013. 1. 22. 12:28경 강원 속초시 F에 위치한 G병원에서 치료를 받던 피고인의 카니발 승용차의 동승자인 피해자 H(62세)을 다발성 장기 손상으로 사망에 이르게 하였다.
