A defendant shall be punished by imprisonment with prison labor for not more than ten months.
Reasons
Punishment of the crime
On November 7, 2014, the Defendant sentenced the Ulsan District Court to six months of imprisonment with prison labor for the obstruction of performance of official duties, and completed the execution of the sentence at the Ulsan District Court on January 6, 2015.
1. Fraud;
A. On March 2, 2015, the Defendant ordered the victim C to provide alcohol and food as if the victim C would pay the price to the victim at the “Ecafeteria” operated by the victim C in Ulsan-gu, Ulsan-gu, Seoul-gu.
However, there was no money in possession at the time and there was no intention or ability to pay the money later, even if the defendant takes the order of alcohol and safe-time.
The Defendant received 17,000 won from the victim, namely, at the time of the instant suit, the amount of KRW 17,00,000.
B. On March 2, 2015, at around 14:18, the Defendant had no intent or ability to pay a charge even if he/she was on a G taxi operated by the Victim F before the electric apartment located in Ulsan-gu Taedong, Ulsan-gu, but there was no money in water.
The Defendant did not pay 5,700 won of taxi charges after getting on a taxi in which the victim is driving for about 15 minutes, and acquired property benefits equivalent to the same amount.
C. Around 19:00 on March 10, 2015, the Defendant ordered the victim H to drink and food as if the victim H would pay the price to the victim.
However, there was no money in possession at the time and there was no intention or ability to pay the money later, even if the defendant takes the order of alcohol and safe-time.
The Defendant received from the victim the amount equivalent to KRW 22,00, such as 1 main and beer, from the victim.
2. On April 19, 2015, the Defendant was under the influence of alcohol to the victim under the influence of alcohol in order to place an amount equivalent to KRW 35,00,00, 15, 35,000, i.e., flin in “M restaurant” operated by the victim L (the age of 49) in Ulsan-gu from around 14:40 to 17:00.
