1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Geumcheon-gu Seoul Metropolitan Government D (hereinafter “instant building”) concluded a trust agreement with the K non-real estate trust company (hereinafter “K non-real estate trust”) regarding the new construction and sale of the building, and the K non-real estate trust newly built and sold the instant building in accordance with the above trust agreement.

B. On August 18, 2008, E purchased No. 104 of the instant building from the K non-real estate trust (divided as No. 104 and No. 104-1, Jun. 23, 2010; hereinafter “No. 104 before division”). The sales contract No. 104 before division included “convenition point” in the item column of business.

On September 30, 2009, the Plaintiff acquired the status of the buyer as to No. 104 before the division from E, and at the time, the Plaintiff and the Plaintiff deleted the entry of the “convenition store” in the business type column of the sales contract No. 104 before the division and entered the phrase “convenition store and main product monopoly.”

C. On December 21, 2009, F purchased No. 101 and No. 103 (hereinafter “No. 101” and “No. 103”) of the instant building from the K non-real estate trust. The type of business in the sales contract No. 101 and No. 103 is indicated only as “lease”.

Defendant B Co., Ltd. (hereinafter “Defendant Company”) acquired the status of buyer from F on May 19, 2010 as to 101 and 103.

The type of the sales contract in 101 and 103 was described only as "lease".

On July 28, 2010, the Defendant Company: (a) sold the instant building No. 102 (hereinafter “No. 102”); and (b) on October 22, 2010, the instant building No. 105 (hereinafter “No. 105”) were sold from Porate Development (hereinafter “No. 105”) (hereinafter “No. 105”), respectively.

The type of business in the sale contract No. 102 is called "dyer store/real estate".
