Reasons
Punishment of the crime
1. On November 23, 2012, Defendant A: (a) accessed the website via a computer, deposited KRW 1,00,000 in the account in the name of Gwangju Bank (G) designated by the operator; (b) paid cyber money corresponding thereto; and (c) sold the actual horse racing in the name of the Republic of Korea relayed real time on the said website; and (d) performed gambling in the way of exchanging and commercializing cyber money by receiving payment according to the dividend rate; and (b) from that time until May 1, 2016, the Defendant deposited KRW 386,710,000 in total over 309 times, such as the list 1 second sentence of the crime list.
As a result, the defendant was gambling using a racing conducted by the Korean Marina.
2. On November 2, 2012, Defendant B: (a) accessed the Defendant’s home located under the same subparagraph, using a computer to the Internet private horse site (I); (b) deposited KRW 1,00,000 in the Gwangju Bank account (G) in the name of F, designated by the operator; (c) deposited KRW 1,00,00 in money; (d) paid the corresponding cyber money and deposited the betting result in real-time racing in the Republic of Korea’s home located under the supervision of the Korean Marin society, which is relayed on a real-time basis on the said site; and (e) performed gambling by exchanging and commercializing it according to the dividend rate, from that time to January 16, 2016, the Defendant deposited KRW 212,730,000 in total over 257 times as shown in the attached Table 2 of the Crimes Day.
As a result, the defendant was gambling using a racing conducted by the Korean Marina.
3. On January 20, 2013, the Defendant: (a) visited Kelas located in the JJ on the part of Sinpo City, by means of a computer; (b) deposited KRW 5,00,000 to the Agricultural Cooperative Account (M) designated by the operator; and (c) deposited KRW 5,00,000 in corresponding amount.
