Reasons
Punishment of the crime
[criminal history] On December 5, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Narcotics Control Act (compact) in the support of the Suwon Friwon, and completed the execution of the sentence in the Heung prison on April 21, 2014.
[Criminal facts]
1. Sale and purchase of Mactopphones (one-name “philopon”; hereinafter referred to as “philopon”);
A. On July 2015, the Defendant committed the crime, around July 2015, 2015, 1.50,000 won from F in the street in the vicinity E located in Bupyeong-gu Incheon Metropolitan City, for a 150,000 won.
Accordingly, even if the Defendant is not a narcotics handler, he traded a philophone, which is a local mental medicine.
B. On September 2, 2015, the Defendant: (a) promised to receive KRW 1.50,000 from F at the house of Nam-gu Incheon Metropolitan City, Nam-gu, to receive KRW 203,00,00 from F; and (b) provided a disposable injection containing approximately 0.33 gramphones to F in return for the promise to receive KRW 1.53 gramphones.
Accordingly, even if the Defendant is not a narcotics handler, he traded a philophone, which is a local mental medicine.
2. On September 2, 2015, the Defendant administered philophone medication by inserting approximately 0.05 grams in the Defendant’s house located in the Nam-gu Incheon Metropolitan City H 301, and dilution in the Defendant’s arms by dilution in the single-use injection machine.
Accordingly, even if the Defendant is not a narcotics handler, he administered a philophone, which is a local mental medicine.
3. From July 2015 to September 11, 201:20 on September 4, 2015, the Defendant, who possesses phiphones, put three disposable injection equipment containing approximately 0.58g opphones, approximately 0.59g, and approximately 0.45g gramphones into the pen, and stored on the page.
Accordingly, even if the Defendant is not a narcotics handler, he possessed a philophone, which is a local mental medicine.
