Punishment of the crime
[criminal records] On May 28, 2015, the Defendant was sentenced to a suspended sentence of two years in August, 2015 to a crime of violation of the Game Industry Promotion Act at the Suwon District Court’s Pyeongtaek District Court’s House, and the said judgment became final and conclusive on June 5, 2015.
[Criminal facts] When the Defendant intended to prepare gambling expenses, he had forged a written application for a loan under the victim B, which was de facto marital relationship, and had the borrower receive a loan from the lending company.
1. The Defendant committed the crime against Hyundai Capital Co., Ltd.: (a) around February 1, 2012, at the victim Hyundai Capital Office located in Bupyeong-gu Incheon Bupyeong-gu, Incheon. (b) around February 1, 201, he/she had been kept there.
After entering “C” and “B” in the “resident registration number column” column for the application for the certification loan of the World Bank WEB, the applicant signed the “B” column as “B” and submitted to the employee in charge of the Hyundai Capital Loan Co., Ltd. who knows the fact as a document duly formed, and received a loan from the victim company KRW 6 million on the same day.
Accordingly, the defendant, for the purpose of exercising rights and obligations, has forged the application for the certification loan of the Doro WEB in the name of the private document B, and had the victim's company deceiving it and acquired it by borrowing 6 million won from the victim company.
2. On April 24, 2012, the Defendant committed a crime against the Victim HK Savings Bank, Inc., the Defendant, using a computer located in the website of the Victim HK Savings Bank, Inc., which was located in Gyeyang-gu, Incheon, Gyeyang-gu, Incheon, for the purpose of having access to the Internet site of the Victim HK Savings Bank, and conducting business affairs without obtaining B’s consent, by entering the “B”, “B”, “resident registration number No. 102 Dong-dong 604,” and “resident registration number No. 102 Dong-gu, Incheon, Incheon, to complete the loan application by entering the “C” and completing the loan application.
