A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. The crime committed on April 26, 2014;

A. 나. 업무방해 피고인은 전항 기재 일시, 장소에서 위와 같이 피해자 D를 때릴 듯이 위협하며 주방에 침을 뱉고, 배달을 가려는 피해자의 팔을 잡아 비튼 다음, 계속해서 E 내 손님들에게 다가가 침을 튀기며 “반찬을 재활용한다, 밥맛이 없다”며 큰 소리로 말하는 등 소란을 피워 약 20분간 위력으로 피해자의 업무를 방해하였다.

가. 특정범죄가중처벌등에관한법률위반(보복협박등) 피고인은 2014. 5. 18. 09:00경 위 E에서, 그 전인 2014. 2. 17.과 2014. 4. 26. 피해자 D가 피고인을 업무방해로 신고하여 피고인이 경찰조사를 받게 된 점에 대해 피해자를 보복할 목적으로 피해자에게 “이 식당을 엎어버리겠다, 이 씹할 년, 좆같은 년”이라고 협박하고, 이어 피해자가 다시 경찰에 신고하여 출동한 경찰관에게 피해 사실을 이야기하자 보복할 목적으로 피해자에게 “한번 봐라, 내가 이 식당 문 닫게 한다, 좆빨 년”이라고 말하여 피해자를 협박하였다.
