A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 24, 2019, the Defendant received a proposal that “a loan may be made,” and that “a loan may be granted from a name-free winner who assumes the “B” employee of the lending company (hereinafter “self-title B”), and that a loan may be granted by creating a false transaction performance, and if the Defendant repeatedly withdraws money deposited in the current account from the bank counter to the designated bank counter and delivers the money to the sender in cash, it is possible to grant a loan of KRW 10 million.”

J. B, on February 26, 2019, falsely speaks that “A victim C, who reported and contacted letters of loans at an unsound place, is working in D Association E, with a credit rating of KRW 30 million, 10%, and with a credit rating of KRW 10%, if the existing loans are repaid, it is possible to repay loans because credit rating is enhanced and it is possible to repay loans.” Accordingly, the victim receives KRW 13 million from C to the corporate bank account (Account Number:F) in the name of the defendant at around 10:08 on February 26, 2019. At that time, he/she assumes the person as bank staff in the victim G and H and makes a false statement to the same effect, and then submits a public prosecution from the victim G to the above corporate bank account in the name of the defendant on February 26, 2019.” However, in light of the evidence duly adopted by the court as well as the process of changing the indictment and exercising the defendant’s right of defense.”

On February 26, 2019, 15 million won was transferred to the same account from the victim H on or before February 26, 2019, respectively.

On February 26, 2019, the Defendant instituted a public prosecution by stating that “13 million won was stated” at the Green Central Point of Enterprise Bank Green Cross located in the Gangseo-gu Busan Metropolitan Government, but the Defendant appears to be a simple clerical error in light of the entire written indictment, as it appears to be a simple clerical error.
