A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant’s forced indecent act is the owner of “C cartoon rooms” on the 1st underground floor in Sungnam-gu, Sungnam-si, Sungnam-si, and the victim D(n, 22 years old) is a person who has worked at that place.

가. 피고인은 2015. 3. 초순 13:00 경 위 ‘C 만화방 ’에서 피해자에게 카운터 조작법을 알려준다고 하면서 갑자기 오른손으로 피해자의 엉덩이를 1회 툭 쳐 강제로 추행하였다.

나. 피고인은 2015. 3. 중순 18:00 경 위 ‘C 만화방 ’에서 피해자에게 주급을 지급하면서 “ 고생했다” 고 말하며 피해자를 강제로 껴안으려고 하고, 이에 피해자가 밀쳐 내자 다시 강제로 꽉 껴안고 피해자의 엉덩이를 손으로 1회 툭 쳐 강제로 추행하였다.

피고인은 2015. 7. 말 16:00 경 위 ‘C 만화방 ’에서 손님이 주문한 라면을 끓이고 있는 피해자의 뒤로 다가가 갑자기 손으로 피해자의 엉덩이를 1회 툭 쳐 강제로 추행하였다.

2. No person shall photograph the body of another person against his/her will, using a camera or any other mechanical device equipped with similar functions, which may cause sexual humiliation or sense of shame;

Nevertheless, around 12:00 on August 3, 2015, the Defendant taken four times in the same day, such as taking photographs of the body part of the victim, which might cause a sense of sexual shame by using his/her body function as a camera of his/her mobile phone, against his/her will, and taken two times in the same manner, around July 15, 2015; around July 20, 2015; around July 22, 2015; around July 23, 2015; around July 23, 2015; around July 27, 2015; and around July 27, 2015; and around July 1, 2015; and around July 1, 2015; and around July 1, 2015; and around July 31, 2015;
