A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 22, 2014, at around 15:20, the Defendant: (a) accessed the victim D (hereinafter referred to as 15 years of age) who was walking a path near Seo-gu Daejeon, Seo-gu, Daejeon; (b) stated, “In the Republic of Korea, the Defendant is a student who majored in the design at the university, and is a student who is assigned the design at the university, and shall affix a female’s photo because of the subject matter.” After the Defendant’s consent, the Defendant she saw the victim’s picture with his/her handphone and received the victim’s contact address.”

As above, the Defendant sent to the victim a message with the content that “one-half hours after making a declaration by sealing” to Kakaox, and then sent the message to the victim, “Iman who will affix his/her photo,” and again promised to do so on the following day. On January 23, 2014, the following day, around 17:30, the Defendant sent the victim a message to the victim, and then came to the 6th floor, the first floor of the said apartment building, which was the second floor of the said apartment building, around the near the victim, Seo-gu, Daejeon.
