1. The punishment of the defendant shall be determined by six months;
2. Provided, That the above punishment shall be imposed for two years from the date this judgment becomes final and conclusive;
Reasons
Punishment of the crime
From December 2014 to October 2015, the Defendant was working as the representative at the Dong Branch Co., Ltd., Ltd. in Ansan-si B, and was in mind at around March 2015 through fees to be paid when concluding an insurance contract with the shortage of operating expenses of the said office.
1. On March 31, 2015, the Defendant: (a) drafted an application for an insurance contract of “D” at the above C office; (b) made E, an employee of the said C office, enter “F” in the name column of the person confirming the store location in the said subscription; (c) made E enter “F” in the interview column for confirmation of the interviewer; and (d) made E enter the main contents in the insurance solicitor column of confirmation; and (c) signed “F” in the name of F.
As a result, the Defendant, for the purpose of uttering, forged one copy of the subscription for an insurance contract in the name of F, a private document on rights and obligations, and forged the F’s subscription for an insurance contract with a total of seven times from the above date to April 30, 2015, as shown in the list of crimes.
2. Uttering a falsified investigation document;
A. On April 1, 2015, the Defendant sent a forged insurance contract offer at the above C Office as stated in paragraphs (1) through (3) of the attached Table of Crimes List, to the employees of the said C Headquarters, who knew of the forgery, as if the document was duly formed.
B. On May 1, 2015, the Defendant sent a forged insurance contract offer at the above C Office as prescribed in paragraphs 4 through 7 of the attached Table of Crimes List, to the employees of the said C head office who knew of the forgery, as if the document was duly formed.
