1. The defendant shall receive from the plaintiff a procedure for the registration of ownership transfer with respect to the land of 27,048 square meters in the Gu-si, Gu-si.
Reasons
1. Basic facts
A. On December 18, 2017, the Plaintiff obtained permission for solar power generation projects (facility capacity 994KW) on December 18, 2017, with respect to the land owned by the Plaintiff (hereinafter “instant land”). Nonparty D obtained separately permission for solar power generation projects (facility capacity 881.28KW) on March 12, 2018.
1. Land subject to permission for solar power generation of the instant land: (a) the completion of the permission for solar power generation of the instant land; (b) the 999KW ( December 18, 2017) 881.28KW ( March 12, 2018); and (c) the capacity of the electric power line : surplus;
2. Terms and conditions of a contract: 1,630,00,000 won and the contract amount of KRW 163,000,000 (10%) shall be paid on the date of the contract;
An intermediate payment of KRW 489,00,000 (30%) contract shall be paid within five days upon completion of the authorization and permission for the establishment of a new factory, and a contract unpaid during the period shall be null and void.
Any balance of KRW 978,00,000 (60%) shall be paid within seven months from the contract date.
3. 1) All rights, such as the permit for solar power generation projects permitted, and related design drawings, shall be transferred to the buyer. 2) Prior deliberation and verification of authorization and permission for the use of the factory site, and the down payment shall be refunded within seven days when building-to-land ratio is non-scheduled within 20%.
3) The seller actively cooperates with the seller to secure access roads according to the plan at the time of permitting the development of the road (the permission to occupy and use the national land and its own design). 4) The seller actively cooperates with respect to the occurrence of civil petitions arising from the construction of solar power infrastructure, and the seller takes up two graveyards within one month when the intermediate payment is made.
5) The succession to the amount of KRW 429,00,000 (the loans of KRW 2.9 billion to the old American Industrial Association) shall be based on the buyer’s will. B. The Defendant plans to build a factory in the instant land and to undertake solar power generation projects, and on April 3, 2018 between the Plaintiff and the Plaintiff, the Plaintiff sells the instant land to the Defendant on the following terms (hereinafter “instant sales contract”).
AB concluded the agreement.
C. The Defendant shall pay to the Plaintiff KRW 603,00,000 out of the purchase price as follows, and the remaining purchase price is KRW 1,027,00,000.
