A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Around October 2015, the Defendant: (a) received a proposal from B, the Defendant’s spouse, “I will no longer lend money from the victim C; (b) I would like to forge a real estate sales contract as if I purchased an apartment, thereby I would like to borrow money; and (c) intended to acquire money by deceiving the victim.”

On October 10, 2015, according to the above public offering, the Defendant called as follows: “Around August 10, 2015, the Defendant called the victim’s dwelling area of the D Apartment E, Y and sent the purchase and sale contract of real estate, stating “G” as “B”, stating that “B is liable for the purchase and sale of the apartment, even if the purchase and sale of the apartment was to be paid with the payment of the money, even if the apartment was to be made with the payment of the money.” On October 13, 2015, the Defendant sent the purchase and sale contract of the real estate, stating “B” as “B”, “B” to the part of the victim’s dwelling area, “B” and “B80,000,000 won in the purchase and sale column of the goods,” to Kakao Stockholm message.

However, the Defendant did not purchase the above apartment from G, and the real estate sales contract sent to the victim was forged by the Defendant, and even if B did not borrow money from the victim due to no particular income and property at the time, there was no intention or ability to pay the money on behalf of the victim.

The Defendant and B, as above, deceiving the victim as above, received from the victim a total of KRW 77,80,000 from around October 10, 2015, a transfer of KRW 8 million from the new bank account (Account Number: H) in the name of B, as well as from November 24, 2015.

Accordingly, the defendant received property from the victim in collusion with the victim B.
