A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Although the Defendant did not deal with psychotropic drugs, so it is not a person handling narcotics, the Defendant sold, received, or possessed a penphone as follows.
1. Purchase and medication of penphones using the Internet;
A. On September 7, 2015, the Defendant: (a) around September 22, 2015, at the Defendant’s residence of Seo-gu Incheon, Seo-gu, 902 Dong 1002, 1002; (b) decided to purchase a penphone from a person (i.e., Ad) whose name cannot be known with smartphone display C; and (c) the same year.
9. 8. 01:24 around 01:00 won in foreign exchange bank account (E) and around 01:47 on the same day, the sum of KRW 1,400,000 in total was remitted to KRW 1,40,000 on the same day. At around 02:30 on the same day, a person whose name cannot be known purchases a penphone by means of bringing about about 1g of philopon to a flopic male toilet in the underground part of the building near the Seoul Gangnam-gu Seoul Metropolitan Government FF Station, which is a place where the above name was sent by a photograph and a person whose name cannot be known.
B. At around 04:00 on September 8, 2015, the Defendant administered phiphones by inserting part of 1g of phiphones purchased in a single-use injection machine as described in the foregoing paragraph, and melting them in water with water, and administering phiphones into arms.
C. On September 1, 2015, at around 08:00, the Defendant administered philophones by inserting part of the philophones purchased in a single-use injection machine as described in the foregoing paragraph, and melting them in water with water. D.
Around 18:52 on October 21, 2015, the Defendant deposited KRW 800,000 with the Agricultural Cooperative Account (J) in the name of the first person known by the person (i.e., ID) who was unable to identify the name of the smartphone display C in Seo-gu Incheon, Seo-gu, Incheon. On October 21, 2015, the Defendant deposited KRW 80,000 without the passbook. On October 22, 200, the Defendant, at around 04:00 of the same month, sent the above name to a photograph by a person who was unable to know, as a place where the said name was sent by a photograph, to a male toilet near the L market located in Gangnam-gu, Seoul, Seoul, a place where the said name was sent by a photograph, oneg of the phiphone-phone
