1. The Defendant’s KRW 32,901,310 as well as annual 6% from June 30, 2015 to July 15, 2016 to the Plaintiff.
Reasons
1. 【Fact-finding 【Evidence】 without any dispute, Gap 1, Gap 2, Gap 3, Eul 4-1 through 63, Eul 9, and the purport of all pleadings;
A. The party concerned is a corporation with the business purpose of manufacturing and selling freezing parts, manufacturing and selling various dairy materials, and all the business incidental to the above paragraphs, and the defendant is a corporation operating a double-generation business.
B. On July 6, 2010, the Plaintiff and the Defendant entered into a contract with the Defendant to supply and install the said facilities to the Defendant’s mass field (hereinafter “instant contract”). On July 6, 2010, the Plaintiff entered into a contract with the Defendant for the supply and installation of the product supply and installation works with respect to the supply and installation works of the scam (scam)-3000 group 5 group 5 group 5 group 5 group 5 group 3000 group 8 group 15 group 15 group 15 group 5 group 15 group group 15,130,000 won, and delivery date from October 25, 2010 group 1.
C. The Plaintiff’s product supply and installation completion was completed around 201, but the Plaintiff did not install 0.5 of the case, and the amount corresponding thereto is KRW 10,088,960.
The Plaintiff received KRW 1,020,109,730 from the Defendant as the price of goods, etc.
E. The Defendant’s payment of the price for the Defendant’s goods, etc. is KRW 1,095,615,917, which was directly paid to the Plaintiff or directly paid to the Plaintiff’s business partner as stated in the attached Form payment statement regarding the instant contract.
2. The allegations by the parties and the judgment of this court
A. According to the above facts, the defendant is obligated to pay KRW 1,19,9,911,040 (=1,30,000,000-10,080-10,088,960) for actual goods, barring special circumstances, 9,801,310,000 for the remainder of goods, excluding KRW 1,020,109,730 for actual goods, excluding KRW 1,020,109,730,00 for actual goods, excluding KRW 1,130,000,000-10,08,000-10,008,00-10,020,09,109,730).
