Defendant shall be punished by a fine of 20 million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

[Status of the Defendant is the head of the E business Bureau (hereinafter “Specialized Business Bureau”) that performs projects to support the Ministry of Education, professors of physical therapy and graduate schools at B University, vice-chairperson of the Industry-Academic Cooperation Foundation, C Support Center director, D Center director, and E Business Bureau (hereinafter “Specialized Business Bureau”).

The Defendant, while conducting research on the research tasks requested by B University, government agencies, and enterprises, or joint research institutes, requested research funds from the victim B University, B University, Industry-Academic Cooperation Foundation.

The victim industry-academic cooperation foundation concluded a contract with research subjects awarded by each government agency, etc. and managed the project funds, and if the responsible research institute claims the payment of the research funds under the name of personnel expenses for researchers, meeting expenses, and visiting equipment, the project funds was executed accordingly.

1. Around September 2010, the Defendant: (a) took overall control of the research project as a researcher in charge of “F research projects” supported by the Small and Medium Business Administration; (b) filed an application for registration of the Student Research Institute with H in charge of the victim industry-academic cooperation foundation, and filed an application for payment of the personnel expenses of the researchers.

However, the above G does not have any participation in the above research, and the defendant did not have any intent to pay the above labor cost to G.

Nevertheless, as above, the Defendant, by deceiving a staff member in charge of the victim, received 100,000 won from the victim's I bank account of G which did not participate in the above study on September 20, 2010 as personnel expenses, and received 79 times in total, including a total of 29,335,450 won from the victim by registering a person who does not participate in the actual experiment by September 23, 2014 as a researcher and receiving personnel expenses.
