1. As to the Plaintiff KRW 53,704,050 and its KRW 3,397,850 among them, the Defendant shall pay to the Plaintiff KRW 8,00,000 from March 6, 2019.
Reasons
1. Facts of recognition;
A. The Plaintiff is a government-invested institution that performs the duty of vicarious payment of unpaid wages and vicarious exercise of the right to claim wages upon entrustment by the Minister of Employment and Labor under Article 27 of the Wage Claim Guarantee Act. The Defendant is a company that manufactures sports-for-sports products, manufactures electric products, manufactures electronic products, wholesale and retail business, etc.
The defendant's trade name was changed from "B" to "B", and the defendant B could not pay wages and retirement allowances to workers C, etc. due to business deterioration.
B. C, etc. filed a claim with the Minister of Employment and Labor for the payment of unpaid wages and retirement allowances in accordance with the Wage Claim Guarantee Act, and the Plaintiff, upon entrustment of the above business, provided labor to B on behalf of the company B, and paid 5 persons, such as C, D, E, F, G, etc. totaling 53,704,050 won of wages and retirement allowances.

According to the facts of the determination as to the cause of the claim, the Defendant is obligated to pay the Plaintiff a total of KRW 53,704,050 and KRW 3,397,850 from March 6, 2019 to April 15, 2019, KRW 4,000 from May 15, 2019 to KRW 5,079,079,070 from May 23, 2019 to KRW 8,02,070 from May 23, 2019 to KRW 7,145,120 from June 21, 2019 to KRW 3,397,85,850 to the day following the payment date of each substitute payment, and to pay damages for delay to KRW 3,397,850 from June 21, 201 to the day following the date of each substitute payment to the Plaintiff respectively.
3. The defendant's assertion that the plaintiff made a substitute payment against B or H, the former representative director, corporation B or the former representative director.
